Terms of Service - CERN Marketplace

1. Introduction

CERN Marketplace is provided by the European Organization for Nuclear Research (“CERN”) to allow the CERN community to buy and sell personal objects. It may not be used for commercial advertising.

By accessing https://marketplace.web.cern.ch/ and its related websites, services, applications or tools (collectively referred to as “CERN Marketplace”) you are agreeing to the following terms.

2. Using Marketplace

As a condition of your use of CERN Marketplace you agree that you will not:

violate any laws through your use;
post any threatening, abusive, defamatory, obscene or indecent material;
post any political or commercial advertising;
offer to sell any counterfeit items or otherwise infringe the copyright, trademark or other rights of third parties.
post or otherwise communicate any false or misleading material or message of any kind;
infringe any third-party right or copy, modify, or distribute any other person’s content without their consent;
harvest or otherwise collect information about users, including email addresses, without their consent.

If CERN identifies, or an entitled party (in particular members of the CERN community or owners of copyright, trademark rights or other rights) reports to us, in the correct manner, content infringing these conditions, then such content may be removed by CERN without notice.

4. Liability

You are solely responsible for all information that you submit to CERN Marketplace and any consequences that may result from your post. You will hold CERN free and harmless from such consequences.

CERN does not review CERN Marketplace users’ postings and we are not involved in the actual transactions between users. We do not guarantee the accuracy of users’ postings or user communications or the quality, safety, or legality of what is offered. In no event does CERN accept liability of any kind for the content posted on CERN Marketplace, whether unauthorized, unlawful or otherwise, or for use of CERN Marketplace by users.

You agree not to hold CERN responsible for things other users post or do.

You acknowledge that CERN cannot guarantee, nor promises or warrants, continuous, error-free or secure access to our sites, services, applications or tools, or that defects in the provision of the CERN Marketplace service will be corrected.

Accordingly, CERN is not liable for any loss, whether of money (including profit), goodwill, or reputation, or any special, indirect, or consequential damages arising out of your use of, or inability to use CERN Marketplace.

5. Abuse

CERN and the CERN Marketplace community work together to keep the CERN Marketplace working properly and the community safe. Please report problems, offensive content and policy breaches to us at abuse@cern.ch.

CERN reserves the right at our discretion to refuse or delete content that we believe is inappropriate or breaching these terms, or to restrict a user’s usage of CERN Marketplace, or refuse a user’s registration.

Notwithstanding the above, CERN does not have any obligation to monitor the information transmitted or stored on CERN Marketplace.

6. Content

When you post content on CERN Marketplace, you grant CERN - and represent that you have the right to grant us - a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable (through multiple tiers) right to exercise any and all copyright, publicity, trademarks, design and intellectual property rights to that content, in any media whether now known or to be discovered in the future and wherever we seek to do so. In addition, you waive all moral rights you have in the content to the fullest extent permitted by law.

7. Release

If you have a dispute with one or more CERN Marketplace users, you release CERN (and its staff), from any and all claims, demands and damages (actual and consequential) of every kind and nature, known or unknown, arising out of or in any way connected with such disputes.

8. Personal Information

By using CERN Marketplace, you agree to the collection, transfer, storage and use of your personal information by CERN. In this regard, please note the CERN statement on privacy: https://home.cern/data-privacy-protection-statement

9. General

These terms and the other policies posted on CERN Marketplace constitute the entire agreement between CERN Marketplace and you, superseding any prior agreements. No agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by this Agreement.

Non-enforcement of any particular provision of these terms of use by CERN does not constitute a waiver of any kind.

We may update this agreement at any time, with updates taking effect when you next post or 30 days after we post the updated policy on the CERN Marketplace website, whichever is sooner.
